It is very important that you, as the new family of our kitten(s) know what is involved in adopting one of our kittens.  Below is the sales/adoption agreement for Cyrious Cats.  The agreement is in place to give security and peace of mind to you, and to us.  Please, take a moment to read the agreement.  We are available to answer your questions.

SALES CONTRACT 

BETWEEN CYRIOUS CATS (Seller) and (Purchaser)

THE SELLER AND PURCHASER AGREE TO THE FOLLOWING CONDITIONS:

HEALTH:


The Purchaser agrees to:


Have the kitten examined by a licensed veterinarian within 72 hours (or 3 business days, if your veterinarian is not open on the weekend) of the pickup or delivery of the kitten. If the purchaser fails to take the kitten to a licensed veterinarian within 72 hours of pickup or delivery, this contract will be rendered null and void.


Prior to this exam, the kitten will be quarantined – if the kitten comes into contact with any animal of any species prior to the veterinary examination, it will render the contract null and void. The kitten cannot be returned after the 72 hour health guarantee period has expired, or if the kitten has been exposed to another cat that has not been tested for FeLV and FIV. If a kitten must be returned because of FeLV/FIV, the Purchaser will provide proof of testing for FeLV/FIV for all other cats living in the Purchasers home before a return will be granted.


In the unlikely event of the veterinarian finding life-threatening health issues during the initial exam, the purchaser must provide the seller with veterinarian provided documentation of the issue within 24 hours of the initial examination. If the seller receives this documentation within the 24 hour time period, the kitten will be replaced by a kitten of the same quality and value as soon as an appropriate kitten becomes available.


Once the kitten has left the seller, all additional costs incurred by veterinary care is the responsibility of the buyer.


The Seller guarantees:


The kitten has had all vaccination shots scheduled up to the age of 16 weeks. The kitten has received a complete examination from a veterinarian, and to the seller’s knowledge, at the time of pickup or delivery, the kitten is in good health, and is free of feline leukemia and all other major diseases at the time of sale.


If within one year of date of birth, the cat is found to have a fatal hereditary defect, seller will replace the kitten/cat with another kitten of the same quality and value as soon as an appropriate kitten becomes available. This will not happen until the seller receives proof of hereditary defect in the form of a complete autopsy report from a licensed veterinarian. Fatal genetic defects are limited to hereditary conditions of the heart, liver, and/or kidney.


The Seller is proud to operate a cattery that is FeLV/FIV negative.


This health guarantee does not apply towards any separate causes of death.  For example: mistreatment, failure to administer vet care, loss or theft of kitten, etc.


Often, during times of stress (moving to a new home, meeting new people and animals, being transported by a courier, etc.) cats can sometimes exhibit a variety of symptoms, including runny nose, sneezing, watery eyes, lack of appetite, constipation, or diarrhea. These are normal reactions to stress, and usually of short duration. If your kitten is experiencing any of these symptoms, please mention it to your veterinarian at your kittens’ initial medical examination.

THE FOLLOWING CONDITIONS ARE NOT COVERED IN THE HEALTH GUARANTEE:


Osteochondrodysplasia (OCD) - is a developmental abnormality that affects cartilage and bone development in Scottish Fold Cats. This condition causes the ear fold in the breed and all Fold cats are affected by it. Homozygous Folds are affected more severely than Heterozygous Folds (who will have less severe symptoms, develop the condition at a later age, and may be asymptomatic and not show symptoms). Cyrious Cats takes this condition very seriously and we only breed ethically, never breeding two fold-ear cats, and having all our breeding cats DNA tested to ensure that they are not Homozygous Folds.


Because all Scottish Fold Cats may experience some level of OCD, this condition and any associated physical symptoms (including, but not limited to flexibility of the tail, fold of the ears or cartilage problems) is not covered by the health guarantee. Issues associated with facial structure such as small nasal passages or dental overcrowding are also not covered by this health guarantee.


Seller cannot guarantee against Hypertrophic Cardiomyopathy (HCM).


Colds (viral and bacterial) are not covered in the health guarantee, as they are easily treated and it is common and natural for a kitten to occasionally “catch a cold”.


Worms are not covered in the health guarantee as all kittens are naturally at risk of worms, which can be brought on by the stress of a new home, different environment, new food, etc.


Umbilical hernias can occur shortly after birth if the opening in the abdomen that was once used for nutritional passage does not close. The majority of umbilical hernias will not cause any harmful effects to the kitten, and treatment/surgery for removal of an umbilical hernia is not covered by the health guarantee.


Feline Coronavirus (FCoV) is a common viral infection in cats and is found in cat populations world wide. It generally causes asymptomatic infection, but can cause mild diarrhea. It is not considered to be a serious illness.  However, in rare instances, FCoV can mutate and become Feline Infectious Peritonitis (FIP). FIP is progressive, and sadly, almost always fatal. There is no definitive tool for detecting FIPin a living cat, and there is no approved medication available in North America. Because FCoV is so prevalent in cats, the Breeder is unable to guarantee against FCoV and FIP.


However, if the worst happens and your kitten passes away from FIP within two month of being picked up or delivered, we will replace your kitten with one of the same quality and value as soon as an appropriate kitten becomes available.  In order for the Breeder to replace the kitten, cause of death must be confirmed as FIP by a licensed veterinarian, who has performed a thorough necropsy.

ADDITIONAL TERMS


The Purchaser agrees to:


Not to declaw the kitten. Declawing a cat is a form of unnecessary amputation that leaves the kitten without a way to defend itself. It also leads to a variety of emotional and physical issues the cat and the buyer will have to contend with for the life of the cat.


If the buyer can no longer keep the kitten/cat they will contact the seller prior to rehoming. The seller will always be willing to take the kitten back into their care without refund, if the buyer decides to surrender the kitten by choice. The seller is more than happy to assist with rehoming a previously adopted kitten or cat.


Purchaser agrees to care for this cat/kitten by providing adequate human attention and companionship. The cat will be kept INDOORS ONLY. The Purchaser agrees to maintain proper nutrition for the kitten and will always seek proper medical attention for the kitten when it is required. The kitten will be taken for annual check-ups and all vaccinations will be kept up-to-date.


The Purchaser agrees that the kitten/cat will never be given to or sold to a humane society, PETA, a research laboratory, or any other facilities.


If the kitten is found to be neglected or mistreated at any point in time the Seller reserves the right to repossess the kitten without refund or replacement.

The degree of fold in a kittens’ ears may change due to age, stress and temperature. The fold may return to the original degree, or it may stay in the changed state.


All kittens/cats purchased will be spayed or neutered and microchipped prior to leaving the Cattery.


Kittens may not be picked up or delivered until a minimum age of 16 weeks.  Research has shown that removing a kitten from its parent before that age can cause illness and/or emotional problems.

The seller is not responsible for any return shipping expenses, or any veterinary expenses from examinations, necropsy, lab tests, or other medical expenses.


There will be no cash refunds.


A NON FEFUNDABLE holding fee of $    will hold this cat/kitten until 2 weeks prior to final vetting/ surgery. Final payment towards the remaining balance of the cost of the kitten due when the kitten is 12 weeks old. Payments can be made via Paypal or Venmo.


Kitten must be picked up in a 10 day time frame from the last scheduled vet appointment or additional vet costs will apply.


Cyrious Cats (Seller) reserves the right to refuse an adoption to any person, for any reason, without explanation. We have the right to refuse the adoption at any given time during the adoption process. Any and all deposits or adoption fees will be returned in full if we refuse the adoption.

The parties agree that the terms of this contract are confidential between the parties and their legal counsel. Consequently, the posting of public views, critiques, and comments disparaging of either party is prohibited and the parties agree that a mutual attempt to resolve any differences, and resort to the courts as the final arbiter of disputes, are the exclusive remedies under this contract.


· Any litigation arising from disagreements between Seller and Purchaser must be filled in the county and state of the Seller.


I acknowledge that this is a legal & binding contract and have reviewed and agree to the terms listed above. Any breach of the contract can result in a $1500 fine to the Purchaser. Failure to follow the above contract completely will result in “A Breach of Contract” and shall make this contract null and void. 


This contract applies only to the original purchaser and is NOT transferable. When a deposit is received by Cyrious Cats (Seller), the Purchaser automatically agrees to the terms of this contract, even if both the Breeder and the Purchaser have not yet signed the contract.
